If your house is in your name alone, and you file bankruptcy in North Carolina (NC) you will have to have $35,000 or less in equity in most cases to keep your home in a Chapter 7 Bankruptcy in NC. If your home is in your name AND your spouse's name, you can have up to $70,000 in equity. If you are:
1) NOT filing jointly (as in just you are filing, as opposed to both you and your spouse), and
2) Your house is in BOTH you AND your spouse's names, and
3) The home was purchased during the marriage
