> Mortgage in a Ch 13 Bankruptcy

Ask Sheree a Question!

If you have property that is mortgaged, or that has a consensual lien on it (where you gave the lien) , you have some alternatives in a Chapter 13:

You can keep making timely payments.

If you are behinfd on your payments, you can catch up on the through the Ch 13 plan.

You can always surrender the property and pay for it as if it were just another unsecured debt at perhaps as little as 10% (Middle District 25%) on the dollar.

Completely Strip a lien. Example: If the home is worth less than the 1st mortgage you may be able to strip away the second mortgage because it is essentially an unsecured debt. But there must not be one dollar in equity for the second mortgage or the whole mortgage survives.

A Chapter 13 can destroy a second mortgage that has no equity in the home. Also in a Chapter 13, although the lien is not destroyed the secured clam is divided into a secured and an unsecured part and only the secured part is paid in full. The unsecured part is paid as if it were an unsecured debt.
